These Terms and Conditions define the rules for Orders and use of the website www.marettipetiteshoes.com and constitute an integral part of a transaction between the Customer and the Shop, in accordance with the following definitions.

DEFINITIONS

The Seller, the Shop, the Store, We - the company MARETTI Zebrzydowice 143, 34-130 Kalwaria Zebrzydowska which operates a business enterprise consisting in the sale of goods and provision of services via the Online Shop.

Customer, User, You - a physical person, made in his own name an order at the store.

Order - the Customer's intention to enter into a contract for the purchase of products at a distance through the online store marettipetiteshoes.com


1. GENERAL INFORMATION

We make these Terms and Conditions available in accordance with the Act on the provision of electronic services. The customer, before placing and order, should familiarise with the provisions of the Terms and Conditions. Placement of an order by the customer is equivalent to the customer’s acceptance of the Terms and Conditions. The shop’s user declares that he/she is over 18 years old and has the legal capacity to undertake contracts. The customer gives his/her consent to use the means of electronic communications and acknowledges the fact that all agreements, notifications, information and all other communications received from us by e-mail comply with legal requirements for written notifications. Communication by electronic means does not infringe upon the customer’s legal rights.


2. PLACING ORDERS

In order to place an order, selected products in an appropriate size must be placed into the shopping cart. Then, the customer has to register or log in as a user by completing all data necessary for the order to be executed. The customer has to choose the form of delivery, confirm the order and pay for it using the selected form of payment. The placing of an order imposes the obligation of payment. You can also use the Shop as an unregistered User. In such a case, you will only have to provide data necessary to execute the order. After placing an order, you will receive a message to the e-mail address provided, in which we will confirm that we have received the order. In the following stages, we will inform you of the order’s acceptance for execution, and then, about its dispatching. Registered users will have their history of orders available after logging in. The agreement concerning the order placed is concluded at the moment of making the payment for the order.


3. DELIVERY

Order processing takes up to 8 business days. This is the time during which we make the shoes and then send them.

If you need a selected pair of shoes for a specific date, a wedding or another special occasion, and you are worried that it will not be delivered on time, please contact us. We will check to see if we have a finished pair in our warehouse and inform you when it can be delivered to you.

On the day the order ships, you will receive a message to your e-mail address specified in the order along with the tracking number of the package and a link where you can track it.

European Union countries
DPD courier company delivers packages to European Union countries within 2-6 business days.

Other European countries
The package will be delivered by a local postal service in your country.
The average delivery time can take between 5-10 business days.

United States of America
The order will be sent by international priority airmail. Within your country, the package will be delivered by the United States Postal Service.
The average delivery time can take between 10-16 business days.

Canada
The order will be sent by international priority airmail. Within your country, the package will be delivered by the Canada Post.
The average delivery time can take between 10-16 business days.

South America
The package will be delivered by a local post office in your country.
The average delivery time can take between 12-18 business days.

Australia, Asia
The package will be delivered by a local post office in your country.
The average delivery time can take between 14-20 business days.

The time of delivery for foreign packages is indicated only for estimation purposes and may vary depending on the country of delivery. The carrier bears responsibility for all delays concerning package delivery. We recommend checking the contents of the package in the presence of the courier/delivery person or at the place of collection. If the package or its contents have been subject to damage during transportation, it should not be received and a damage report should be drawn up together with the package deliverer.

Packages delivered within the territory of the European Union are not subject to import duties, taxes or other custom duties.

Deliveries to countries outside the European Union may be subject to import duties, taxes and custom duties according to local legal regulations and are not included in the price of the item or in the shipping fee. Please contact your local customs office in your country and find out which additional costs you can possibly incur.


4. EXCHANGE

The shoe size you chose is not a perfect fit? If you want to, we will exchange your shoes for a new pair in a different size. You have 30 days from receiving the package with your order to make the decision and send the footwear back in order for it to be exchanged. Exchanges can be done only for a different size of the same style. You can also return shoes received and order similar ones in a different size. In such a case, follow the procedure for returning products.

1. Let us know about your wish to exchange your shoes by sending an e-mail. Specify the order number and the model that you want to exchange, as well as the size you want to exchange your pair for.

2. We will reply by confirming whether the exchange is possible. If not, we will ask you to send the shoes back as a return.

We will put aside an appropriate pair of shoes for you if we have it in our storage or we will make new ones in order to make the exchange smoothly and in the shortest time possible.

3. After receiving our confirmation, send the pair to be exchanged. Leave the receipt received in the box and we will be able to identify the package on this basis. Pack the shoes in such a way that the heels are on the opposite sides of the box. Otherwise, the sharp edges of the heel taps can damage the leather surface of the footwear during transportation.

The fabrication of a new pair of shoes as part of an exchange can take up to 8 business days from the day we receive the package.

We will send the new pair of shoes to the delivery address indicated in the order. If you want to change the delivery address, inform us about that in an e-mail. We will reply by sending a confirmation for making the change to the delivery address.

Pay special attention to the soles when trying on the shoes in order to avoid abrasions and stains. It is best to try on the shoes on a soft and clean surface.

Returns do not apply to custom-made shoes modified in terms of their size or width, as well as to modifications made to a standard pair of shoes available.

Only new shoes in perfect condition with their original box and its full contents can be returned. The packaging, spare heel taps and other elements securing shoes during transportation constitute an integral part of the product.

We reserve the right to refuse to accept shoes for exchange after the deadline indicated or if the shoes bear traces of use.


5. RETURN

Within 15 days from receiving a package with the ordered shoes, you (as a consumer) have the right to return it without justification as part of withdrawal from the agreement.

1. Inform us in writing about your willingness to make a return within 15 days from receiving the package. The most convenient way to do that is to send us an e-mail.

Please state clearly that you are withdrawing from the agreement concluded and returning the shoes. Specify which products you are returning by indicating their model and size, order number and the first and last name of the person who placed the order. In the box with the order, you will find a receipt. Leave it in the package and you will not need to make an additional written statement concerning the return.

You can use the statement below. You only have to copy the text, complete it, where needed, and send to our e-mail address. However, the following form of the statement is not obligatory.

2. We will reply by confirming that we have received the statement.

3. Then, within 15 days from sending us the information/statement on the return, send the products back to the address below.

4. After receiving the package with the returned shoes, we will make a refund in the same way, as the payment was made: by refund to the payment card or to the PayPal account.

In case of a return of the whole order, we will reimburse all payments made, including the postage fee. You will only incur the direct costs of returning the products.

Keep the postal receipt for the event of the package getting lost during transportation.


6. PAYMENTS

Payments in the shop can be made via the PayPal payment system. Data transferred during the process of making a payment are encrypted using the SSL technology, which provides the highest level of security. We do not have access to your payment card or bank details at any stage of the payment process.

It is possible to make a payment using PayPal in two ways: via the PayPal user account or you can also pay by Visa or MasterCard card safely, quickly and without registering directly on the PayPal payment page.


7. WARRANTY

Each pair of shoes is covered by a 24-month warranty. We pay special attention to manufacturing shoes with due care and, on average, complaints concern 3 of 500 pairs of shoes made in our workshop.

If the quality of the shoes received do not fulfil your expectations or raise your doubts, inform us about that by sending an e-mail. Specify the order number, the first and last name of the person ordering and the shoe model that is the subject of the complaint. Describe in detail the fault discovered.

We will reply by confirming that we have received the complaint and ask you to send the shoes to our address.

Put a note with information containing the order number or the receipt received together with the order in the box. Then, send the faulty shoes to the address provided below.

After we receive the package with the faulty shoes, we will send you an e-mail informing you about the way in which the complaint will be resolved. We will make an appropriate repair, exchange the shoes for a new pair or propose another solution as fast as possible.

Complaints can be made due to latent faults resulting from technological, design or material reasons. However, complaints concerning damages resulting from the natural wear of shoes or improper use, mechanical damages, cuts, ruptures, abrasions of the leather’s outer surface, dirt, damages resulting from improper maintenance, damages resulting for inappropriate fit between the shoe and the foot shape and damages resulting from wear of the outer part of heels are excluded.

 

8. PRIVACY POLICY

PERSONAL DATA
The personal data in the database of the online shop marettipetiteshoes.com are processed exclusively for the shop’s own needs in order to execute orders and inform customers about the shop’s offers. Personal data are not and will not be disclosed to third parties. The data are collected with due diligence and appropriately protected against access from unauthorised persons in compliance with the Data Protection Act. Pursuant to applicable law, you have the right to access your personal data and to modify or delete them at any time.

COOKIES
Our shop uses cookies to provide services in accordance with the privacy policy. You can set the conditions for storing and accessing cookies in your browser. Cookies are used to adjust the content of the marettipetiteshoes.com webpages to your preferences as a user and to optimise the use of the shop. Cookies are also used to create statistics that help us understand in what way you are using the marettipetiteshoes.com webpages. Cookie files also help us improve the shop’s structures and content. Newsletter is a free of charge service that informs the shop User about new products in the offer by sending selected content periodically by electronic means, that is, in a form of e-mail. Registration of an e-mail address and expressing willingness to receive content by electronical means constitute consent by the User to receive the Newsletter. The shop User has the right to unsubscribe from the Newsletter at any time by entering the e-mail address in the same field as during registration. Newsletter can contain commercial information within the meaning of the Act on Provision of Services by Electronic Means. We declare that the e-mail address submitted by the User will be processed in accordance with regulations, especially the Act on Provision of Services by Electronic Means and the Data Protection Act, and that it will not be provided to third parties.

 

9. FINAL PROVISIONS

Prices applicable at the moment of placing the order apply. Prices may be subject to changes at any time; however, the changes will not apply to orders that have already been placed. All prices include VAT. In all matters not settled by these Terms and Conditions, provisions of the applicable Polish regulations, the Act on protecting consumer rights and on conditions of consumer sales and regulations of the European Union governing online trading will apply.
